Monday, July 31, 1989 The Post-Crescent, Appleton-Neenah-Menosha, Wis. D-5 w4 snd me DETQ O) Obituaries WALTHAM, Mass. (AP) The moment the Boston Celtics had waited a long time for was over in minutes. Larry Bird's return to scrimmaging left him with a broken bone in his lower back, his second major injury in as many seasons. "lit this game you have your falls, and you have to take them or you get out," Bird said Sunday night.

"I'm in my 30s now, and you're never as good as you were. What you try to do is stay at the same level" If I'm healthy, I'll play well. I still think I can play." Bird, 32, fell heavily under the basket Saturday night, just five minutes into the first workout of the Celtics' summer camp for rookies, free agents and five veterans. He clutched his back, rolled over on his stomach and winced in pain. He is unlikely to see action again for four to six weeks.

After undergoing surgery on both last Nov. 19, Bird had been 1 expected to be sidelined three to four.jmonths. But by May 2, the date of Boston's final playoff game, he sflll hadn't played a game. He saw, kction in just six games last season. "I didn't think (my heels) would bother me at all in this camp, because I've been playing all he said.

And I won't know how feet are until I play every night for a whole year." The optimism surrounding Bird's returja was wiped out on a freak play he collided with teammate Kelvin Upshaw. Bird returned to the camp at Brandeis University, signing autographs and walking stiffly. "It's just a little bit sore," Bird said. "I feel blessed that I'm standing and moving and that I didn't do more damage. If Bird misses six weeks, he'll return in mid-September, less than a ronmental Center, and the Senior Citizens Center, Menasha.

They got it. Pichardo, Karl Drezek and Mark Parnell combined for a one-hitter to lead the Foxes to a 1-0 win in Midwest League action. Kevin Flora singled in the third inning for the only Angels' hit. Flora was then picked off first.

The 19-year-old Pichardo struck out four and walked one in six innings to improve his record to 5-4. The quality start was needed after the Foxes used five pitchers Saturday. Jeff Hulse hit his ninth homer of the season in the seventh inning. Despite only one hit, Quad Cities did have two scoring chances. David Esquer reached on an error by shortstop Rod Stillweli and Flora walked after two were out in the fifth inning.

But Pichardo struck out Dave Partrick to end the inning. In the seventh, leadoff batter Jim Aylward was hit by a Drezek pitch. He advanced to second on a sacrifice by J.R. Phillips. Hedi Vargas then walked, but Esquer hit into a double play.

Kyle Abbot allowed four hits, with two walks and 10 strikeouts in 6'3 innings as his mark fell to 2-3. U.S. District Judge John D. Holschuh; has said he would rule today on vyfhether Rose can keep his lawsuit against baseball before a judge in his hometown who has sided strongly with the Cincinnati Reds manager in preliminary matters. It's up to Holschuh to determine whether the Cincinnati court or the federal court system is the proper place to hear Rose's legal challenge to baseball Commissioner A. Bart-lett' Giamatti.

For more than a month, Giamatti has been blocked from deciding i whether Rose bet on his own team. Rose: could be banned from baseball for life if Giamatti determines thatLsuch wagers were placed. Rose also has been protected froity being fired by the Reds or suspended by Giamatti while his case; is being heard. The protections extend for three days after Holschuh's decision. The question of which court hears Rose's case is pivotal.

Baseball wants the case heard in federal court, in which judges have upheld the commissioner's broad powers in previous legal challenges. Rose wants the matter kept in Hamilton County Common Pleas "I feel blessed that I'm standing and moving and that I didn't do more damage." Larry Bird Celtics' star month before the Celtics open training camp on Oct. 6. The regular season begins Nov. 3.

With Bird, the Celtics won the NBA title in 1986, reached the finals in 1987 and made it to the Eastern Conference finals in 1988. Without him, they didn't clinch a playoff berth until the final day of last season, had their worst record in 10 years and were swept in three games by Detroit in the first playoff round. The return of the three-time NBA most valuable player figured to make Boston a contender again. Bird had played well in a charity game at Indianapolis on June 25. Celtics coach Jimmy Rodgers said Bird's injury wouldn't change the team's approach to preseason training.

"The biggest problem is that it's a major disruption in his own summer workouts to rehabilitate his ankles," Rodgers said. The annual camp at Brandeis is primarily for rookies and free agents hoping to make the Celtics, impress other teams or stay in shape. Some veterans usually show up. Bird and Upshaw did. "I've iust come here to play basketball because I haven't played in a long time," Bird said before the scrimmage.

"I just want to play against some competition." He was hurt in the camp's first scrimmage, although he played for a minute after the fall before leaving the court. Court, in which Judge Norbert A. Nadel has shown a willingness to go into what he termed "uncharted waters" in making his decisions. On June 25, Nadel granted Rose a temporary restraining order protecting him from firing or suspension. The judge said he agreed with Rose's lawyers that Giamatti had prejudged the case against Rose.

Nadel was widely criticized in the media for his unprecedented decision, which prevented the commissioner from doing anything with Rose's case. Some commentators suggested that making the decision had improved the judge's chances for re-election in 1990. Baseball's lawyers have hammered at the political concerns in their arguments before Holschuh. They accused Rose of balking at having his case decided in any court "other than one which is most subject to the influence of local pressures produced by his fame, notoriety and close identification with the city of Cincinnati." Rose's lawyers said they want the case to stay before Nadel because that's where it properly belongs. They accused baseball's lawyers of trying to get a more favorable court by going to a federal judge.

"We do want to trade Steve Pelluer," Johnson told the Fort Worth Star-Telegram. "But I'm not that active in the trade situation. We're going to let the Steve Pelluer trade come to us." "He's made such great progress. He was ready to make the next step, to put the emphasis back on basketball," Rodgers said. "He's not going to be able to do that for a while. Team spokesman Jeff Twiss said treatment will consist of massage, application of ice, electrical stimulation and medication. Bird fractured a small bone, called the transverse process, that protrudes from a vertebra, but suffered no neurological or disc problems, Twiss said.

For now, all Bird can do is wait. just have to live with it, heal up, go back and wait and see how it is six weeks from now," he said. PETE ROSE wants his suit against baseball to remain in hometown court. in Holschuh's decision. Whether the Reds are a spectator in the case an "innocent bystander," as baseball lawyer Louis Hoynes Jr.

called them in court arguments is a central issue in determing where the lawsuit is heard. If he decides to keep the case in state court, Holschuh will have determined that the dispute is between two entities that reside or do business in Ohio. That would involve one of two findings: that the case technically is between Rose and the Reds, an Ohio team, or that major league baseball is an unincorporated association doing business in Ohio through the team, and thus subject to being sued in Ohio courts.
